Terms and Conditions

These Terms & Conditions (“Terms”) apply to purchases and bookings made through our website and in-store, including retail products, gift cards, lessons, classes, range services, and memberships. By placing an order, booking, or purchasing a membership, you agree to these Terms.

1) Eligibility & Legal Compliance

You agree that:

You are legally permitted to purchase and possess the products/services you are ordering.
You will comply with all applicable federal, state, and local laws and regulations.
We may refuse service, cancel an order, or require additional verification where lawful or necessary for compliance or safety.

Age restrictions: Some products and services are age-restricted. You are responsible for meeting all age requirements, and we may require valid government-issued photo ID at pickup/check-in.

2) Safety, Assumption of Risk, and Waivers

Firearms training and range-related activities involve inherent risks. By purchasing lessons, classes, range time, or a membership, you acknowledge and accept those risks.

Separate waivers: Participation in range and training activities may require signing additional documents (including a liability waiver/release and range rules acknowledgment) in-person or electronically prior to participation. If you refuse to sign required waivers, you may be denied participation and may forfeit fees as described below.

3) Orders, Pricing, Taxes, and Payment

Pricing: Prices may change without notice. The price charged is the price shown at the time of checkout.
Taxes/fees: Sales tax and any applicable fees are added at checkout (or at pickup where applicable).
Payment: We accept approved payment methods displayed at checkout. You authorize us (and our payment processors) to charge your payment method for the full amount of your purchase, including recurring membership billing where applicable.
Fraud/chargebacks: Suspected fraud may result in cancellation, refusal of service, and/or account restriction. If you initiate a chargeback without first contacting us to resolve the issue, we may suspend your account and future purchases.

4) Order Acceptance, Cancellations, and Refusals

Your order is not guaranteed until accepted by us. We may cancel or refuse orders for reasons including (but not limited to):

Inventory errors or pricing mistakes
Suspected fraud or unauthorized payment
Legal or compliance restrictions
Safety concerns or policy violations

If we cancel an order after payment, we’ll issue a refund to the original payment method for the amount paid (minus any non-refundable fees explicitly disclosed, if applicable).

5) Shipping, Pickup, and Delivery

Shipping: If shipping is offered, shipping timelines are estimates and not guaranteed. We are not responsible for carrier delays.
Pickup: Some items are in-store pickup only. We may require ID and order confirmation at pickup.
Risk of loss: Risk of loss transfers upon delivery to the carrier for shipped items, or upon pickup for in-store pickup items.

6) Firearms, Ammunition, and Regulated Items (Including NFA)

Because firearms and certain items are heavily regulated, additional rules apply:

Firearms:

Firearm sales and transfers are subject to all applicable laws and store policies.
Where required by law, purchase completion may require a background check and/or additional paperwork.
If a background check is denied, delayed beyond store policy, or cannot be completed for any reason, refunds (if permitted) will follow our Firearms/Regulated Items refund policy below.

NFA / Regulated Items:

NFA and other regulated items may require additional steps, documentation, fingerprints/photos, tax stamps, and processing times that are outside our control.
Processing times are not guaranteed. You are responsible for completing required information accurately and promptly.
Fees paid for certain services (processing/admin fees) may be non-refundable where disclosed.

Ammunition and restricted items:

Ammunition and other restricted items may be in-store only and may require age verification.
We may limit quantities or refuse sales consistent with law and safety.

7) Lessons & Private Instruction

Scheduling/attendance

You are responsible for arriving on time and prepared with required items (ID, eye/ear protection, etc.).
Late arrival may shorten your session without refund (to avoid delaying other customers).
Instructor availability may change; we may reschedule if needed.

Rescheduling

Reschedules must be requested at least 24 hours in advance.
Requests inside the reschedule window will be treated as a no-show.

No-shows

No-shows will forfeit the full amount paid.

Equipment note

If you do not own a firearm, we can provide options for use during training per store policy. If you plan to purchase a firearm, we strongly recommend waiting until after your first lesson so you can make a more informed choice.

8) Classes (Group Instruction)

Seat reservation

Your seat is reserved only after payment/confirmation.

Transfers

Class registrations are non-transferable.

Minimum enrollment / cancellations

We may cancel or reschedule classes due to low enrollment, instructor illness, weather, safety, or other operational issues. If we cancel, you may choose a reschedule or refund.

Student cancellations

If you cancel 36 hours before the class, you may reschedule your class.
If you cancel inside 36 hours, there is no refund.

9) Memberships (Recurring Billing)

If you purchase a membership, you agree to the following:

Billing & renewal

Memberships will renew automatically on a monthly basis.
You authorize recurring charges to your payment method until canceled in accordance with these Terms.

Cancellation

You may cancel by contacting us 931-202-1640 or mymarksmanllc@gmail.com.
Cancellations must be submitted at least 5 days before your next billing date to avoid being charged for the next cycle.
Membership fees already billed are non-refundable unless required by law or explicitly stated otherwise.

Non-transferable

Memberships are for the named member only and are not transferable unless explicitly stated.

Membership rules

Membership benefits, hours, guest policies, and discounts are governed by current membership rules/policies, which we may update from time to time.
Misuse, unsafe behavior, rule violations, or illegal activity may result in suspension/termination without refund.

10) Returns, Refunds, and Store Credit Policy

Unless otherwise required by law, our general policies are:

All sales final for:

Firearms (new and consignment)
Ammunition
NFA / regulated items (including deposits/fees where disclosed)
Gift cards
Special orders
Clearance/final sale items

Other retail products (non-regulated)

Returns may be accepted within [30] days of purchase with receipt.
Items must be unused, in original packaging, and in resalable condition.
Shipping charges (if any) are non-refundable unless the return is due to our error.

Damaged/incorrect items

11) Promotions, Discounts, and Pricing Errors

Promotions may have separate terms and may be limited by time, quantity, or eligibility.
If a pricing or listing error occurs, we may cancel the order and refund what you paid.

12) Customer Conduct & Right to Refuse Service

We reserve the right to refuse service or remove individuals from the premises for:

Unsafe behavior, negligence, intoxication, impairment, or suspected impairment
Harassment, threats, or disruptive conduct
Policy violations or suspected illegal activity

13) Limitation of Liability

To the fullest extent permitted by law, Marksman, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim related to a purchase or booking will not exceed the amount you paid for the specific product/service giving rise to the claim.

14) Indemnification

You agree to indemnify and hold harmless Marksman, LLC and its owners, employees, contractors, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of products, or unsafe/illegal conduct.

15) Privacy

Your use of our site is also subject to our Privacy Policy.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Venue for disputes shall be in Cumberland County, Tennessee, unless otherwise required by law.

17) Changes to These Terms

We may update these Terms from time to time. The version posted at checkout (or in effect at the time of your purchase) applies to your transaction.
